Robert Byrd Investigating Constitutionality of Hillary Clinton’s Nomination as Secretary of State

 As I wrote about in this post, article 1, section 6 of the constitution prohibits Hillary Clinton from becoming secretary of state. Constitutional scholars interviewed in this article agree that the issue is a valid one. This is not just a controversy dreamed up by radical Republicans, it is not part of the reignited vast right wing conspiracy.

 Now Democrat senator Robert Byrd’s staff is looking into this issue although he refuses to release a statement. This is what he said when RIchard Nixon found a way to skirt the constitution on this very same issue:

The Constitution was “so clear that it can’t be waived,” Byrd said in a Washington Post story at that time. “In my judgment, the bill itself shouldn’t be passed. We should not delude the American people into thinking a way can be found around the constitutional obstacle

 So he has quite a long history with this issue, it will be interesting to see how this plays out. Of course he could be going after president-elect Obama’s pick just because of Obama’s color. After all Robert Byrd was grand poobah of the KKK at one time.
