Defense bill will allow United States citizens to be held at GITMO without trial

December 15, 2011

When Barack Obama was running for the office he currently holds he stated on many occasions that GITMO was being used by Jihadists as a recruiting tool and he also said that GITMO was the antithesis of what America stood for and lowered our standing in the world. Barack Obama promised that he would shut down GITMO if he were elected, and on his first day in office he signed an Executive Order which demanded the closing of the prison camp.

There was one slight problem with this Executive Order; he signed the order without first coming up with a plan about what was to be done with the prisoners who were still held there. The Executive Order carried no weight if there was nothing that could be done with the prisoners and once the Obama regime felt the backlash from its decision to try Khalid Shaikh Mohammed in a civilian court in New York City the regime jettisoned the idea and GITMO remains open to this day.

Recently I wrote a post about how Barack Obama’s lawyers have declared that citizens of the United States are legitimate military targets even if they are on American soil, and the recently passed defense authorization bill basically defines the United States homeland as a battlefield and gives the president the authority to use the military against American citizens.

But according to the article I linked to above, the bill goes further than this. Barack Obama has this little prison camp in Cuba but there really aren’t that many enemy combatants there anymore, so why not put the vacancies to good use? This bill has the potential to do just that, and Barack Obama has flip flopped and is expected to sign this bill into law shortly.

The defense authorization bill will give the president the authority to use the military in any case where an American citizen is thought to be plotting with terrorists, even on American soil–these cases have generally fallen under the responsibility of the FBI and DHS, but not any more. This bill also gives the United States government the authority to hold certain Americans indefinitely and without charges, and yes, it could actually be used to increase the census at GITMO.

United States citizens could actually be  subjected to the very same rules of engagement that the Obama regime felt was unfair to foreigners who were caught while fighting against the United States on the battlefield overseas.

I have maintained the position that people like the Shoe Bomber, the Underwear Bomber, the Times Square Bomber, and the Fort Hood killer–while being traitors to this country–are American citizens who plotted against the United States and were captured on American soil, as such they still deserve constitutional protections and have the right to a trial. If they are found guilty they should be hanged. But apparently the Obama regime does not feel this way, nor does the House or the Senate, and for the first time in American history the government of the United States has basically decided that certain Americans can be labeled as enemy combatants and have their constitutional rights taken away.

At this point I think it necessary to remind everyone that Joe Biden and other Democrats likened the Tea Party to terrorists, and DHS released the infamous “right wing terrorist” report; in the end who decides who the domestic terrorists are?

Unfortunatly Barack Obama seems to be under the impression that his mandate as President extends to equating American citizens with international terrorists.

I believe neither he nor his dim light bulb A.G. Eric Holder would hesitate to imprison any American they considered as a right wing home grown terrorists – leftists would be excluded.

Obama is the antithesis of what an American President should be – unless of course you are living in the fanatasy world of a socialist paradise….WM

I agree, I don’t think the Obama regime would hesitate to go after those evil right wing terrorists. In fact I wouldn’t be surprised if this is part of the plan.

This kind of thing is very Naziesque and I don’t use that word lightly. The potential for abuse is very high.

Doesn’t being an American citizen in America have any benefits anymore?

It doesn’t seem as if being an American comes with any benefits nowadays with the Obama regime. Nobody seems to know what defines a terrorist and yet we are giving the president this power.

Harrison, it seems the only benefit to being an American Citizen is that we get the pleasure of being drained of any money we have so the world can be taken care of and someone else gets the thanks.

I will say it again. Bills like this are unconstitutional. The 5th amendment of the constitution cannot be signed away, the constitution must be amended.

5th amendment: “No person shall be held to answer for a capital, or otherwise infamous crime, unless on a presentment or indictment of a Grand Jury, except in cases arising in the land or naval forces, or in the Militia, when in actual service in time of War or public danger; nor shall any person be subject for the same offence to be twice put in jeopardy of life or limb; nor shall be compelled in any criminal case to be a witness against himself, nor be deprived of life, liberty, or property, without due process of law; nor shall private property be taken for public use, without just compensation.”

So what part of holding American citizens indefinitely is permitted by the constitution. We all know the answer. Just because congress writes it into a bill, and the President signs it does not make it constitutional. Until we the people stand up for our liberties and the constitution they will continue to try an legislate our liberties away. They will continue to skirt the edge of tyranny. When are we going to wake up???

Oh yeah Steve and of course the 6th amendment; “In all criminal prosecutions, the accused shall enjoy the right to a speedy and public trial, by an impartial jury of the State and district wherein the crime shall have been committed, which district shall have been previously ascertained by law, and to be informed of the nature and cause of the accusation; to be confronted with the witnesses against him; to have compulsory process for obtaining witnesses in his favor, and to have the Assistance of Counsel for his defence.”

If you detain an American citizen on American soil indefinitely, you are violating the constitution.

I agree John, there is no doubt that this is unconstitutional and it is up to us to hold their feet to the fire. We must not keep allowing the government to get away with things like this because before long we will have lost our freedoms and will not be able to do anything about it.

I agree, they won’t need to send anyone to GITMO, they will have rooms for them right here. I think that alot of the “off the wall” articles we have been seeing pop up lately, deserve a second look or at least a consideration, given what is coming very fast towards us. We know things are not right and we need all the information we can get. We will NOT get it from the MSM, that is a given. It is sad that it has come to this, we can not trust our own Government.

It’s the MSM who call these articles “off the wall” and keep repeating this over and over. They’re controlled and are saying what they’re told to say.5 yrs ago, I would have said the same. The more I learn about history (not from a school book) the more I realize much of what we’re seeing has happened before. Americans have been brainwashed to believe whatever the propaganda media and it’s government handlers tell us. The more they beat the drum on this Iran nuke theme, the less I believe it. Wars are a distraction. The elite know people are waking up faster and faster and they will do anything, let me emphasize, ANYTHING to distract attention away from themselves and what they’ve done to the entire world.
A Green Beret told me a lot of this stuff 15 or so years ago and it seemed so outlandish I dismissed it. Now it’s happening at frightening speed. I’m more amazed at some people’s response to real news even today, as we are actually seeing the unbelievable happen and the last shreds of the already tattered Constitution being tread upon by those sworn to protect it.

Toldya, they have their “talking points” they have to get across and they have to discredit anything that might take hold. Of course the MSM is being controlled, as you said. They are totally useless, in my estimation. Whatever comes across that tube that the channels play over and over is just a distraction for us to focus on while they do the real work for the “powers that be”. We are in serious trouble here and Steve, I agree that maybe now is the time to post this material, even if it is discredited by some. The information that a few years ago, would have been dismissed, can no longer be ignored, can it? You never know, tomorrow might be too late.

With the talk of new internet regulations being debated it is important for us to discuss these issues and dismiss nothing because we may not have a voice much longer.

I had seen this article and heard what Dr. Paul had to say and yes it is something that needs to be addressed. At what point are the people going to start feeling “safer” having patrols on the streets? It appears it is going in the right direction, isn’t it? Do you think alot of the crisis that pop up are “manmade” just to further the administrations effort to protect us? Isn’t it obvious that we can not protect ourselves and we need Big Brother to step in? They tell us we can’t, so it must be true!!!

I read about this story also and it is frightening to say the least. Lou, I don’t see how seeing the military patrolling our streets can make people safer, in fact I think it will be the opposite. People will be disturbed as it will feel like a police state. This is getting scary.

Steve, certain people, after they are told they will be safer having them patrol, will FEEL safer. There are those that gullible. They will continue watching the “game” on the tube and have all that extra security, that they don’t have to pay for. Then there are the rest of us…you know, the paranoid ones. I am sure we will be labeled as such. Scary? Ya, I think so, too! It will be the usual, 5 minutes of a press conference and we will be told why they have to do this, for our own safety, of course.

I wasn’t raised in an urban welfare environment, so I can’t comment on what makes those people feel safe. I suppose anything that takes away personal responsibility from the recipient class and places it on the government (taxpayer) makes them feel better. Personally, sounds like martial law to me. It’s sad when someone, especially a child, loses their life to senseless violence. But in the spirit of “never letting a good crisis go to waste” now we need troops on the streets. Sounds like a poor excuse to me. This is where it will start. First the urban areas and then to the suburbs and finally the rural areas. And with martial law comes suspended elections. Governor Purdue of NC (?) has already suggested we postpone or cancel upcoming elections.

Yep, that is how it starts, slowly. We will be so much better off, won’t we? What ever happened to “personal responsibility”? Have we become such an entitlement society that we readily accept something like this? I do remember hearing that we should postpone the elections, as well.. I agree that any way you look at it, it is martial law, I hope to most that this will be unacceptable.

I’m sure you are right Lou, there are those that would welcome this police state because of the security they feel is provides without even realizing they are giving up their freedoms for security. Those who oppose this will be told they are overreacting and if they have nothing to hide they shouldn’t worry about it–after all, it is for our own good.

These are the same people that, at most, watch the tv news, period. Apparently they are unaware of what is really going on. Do you think we are overreacting??? I do not have anything to hide, but I sure do not want to have to PROVE I have nothing to hide. Do you remember back a year or so ago, when they had to do a rehaul of the cable system? We ended up with black boxes that had to be used to get any channels other than very local ones, which required a different black box, that was government paid for, with a voucher. Mine in the livingroom goes on and off at random when we are not even watching it….coincidence?? Maybe so, maybe not.
