DHS to give “unlawful presence waivers” to illegal immigrants
The Obama regime has been unable to enact any type of comprehensive immigration reform laws through the Congress so Barack Obama has implemented Plan B–grant amnesty to illegals through dictate.
It started when the Obama regime announced a new immigration policy which would basically decriminalize the act of entering this country illegally, granting amnesty to those who have broken the law to get here. Under this new policy an illegal immigrant does not face deportation for entering the country illegally unless they commit an additional crime once they are here. At that point it is too late and a crime which could have been prevented if the immigration laws were followed has now been enabled by this regime.
But Barack Obama and Janet Napolitano do not think that this law went far enough so they have implemented another guideline which implements “unlawful presence waivers” to all illegals who have a legal family member in America. It is now legal to enter the country illegally if the person entering illegally has a legally residing family member in the United States.
These new guidelines will open up the flood gates and allow a whole slew of illegal immigrants to pour over the border, obtain a waiver, and stay in the country legally at a time when so many legal residents and citizens are looking for work, and could use the jobs that these otherwise unwelcome visitors will now take. Barack Obama is acting on his own, without the approval of the Congress to overturn years of immigration laws and one has to wonder if the Congress is going to challenge him on this or allow him to rule through executive fiat.

I can see it coming, that last t immigration posting you did is STILL getting hits on it. Amnesty will happen. They say they will not take jobs away from Americans again, as well . It is never ending. If you expect Congress to overturn this, don’t hold your breath.

Steve, the “system” needs some help. Hopefully more of these judges in power will start stepping up to the plate and using some of their authority. There is alot of power there that needs to be unleashed on the corruption going on.

This is another example of how Obama likes to govern. With Obamacare, he helped ram it through Congress (didn’t he say something about a majority) and down our throats. With immigration, he can’t seem to get that done, so he is making the rules as he goes along. I think he really means it when he says his job would be much easier if America was similar to China. He seems to think he should be able to do what he wants, when he wants, and with no checks and balances.

No, LD, that’s absolutely untrue.
The waivers streamline, somewhat, a very cumbersome process that people have to go through. There are many limitations on who can get the waiver, and ignoring those facts doesn’t make them go away.

This is just one in a series of defacto mini amnesties implemented by the Obama administration designed to circumvent the will of congress and the American people. It’s all public information; you just need to take a few hours and piece it together.

His uncle was just granted a hardship drivers license after losing his license for drunk driving. How can a person who is here illegally get a drivers license in the first place, and once he is busted how can he be eilgible for a hardship license considering he shouldn’t have been driving in the first place? SOmebody is already protecting him. 😉

Here’s what needs to happen from the House Republicans….not a dime more until their budget is seriously considered in the Senate. Not one more appropriation bill, not one more continuing resolution until the senate takes up Paul Ryan’s budget. The way to stop Obama in his tracks is to turn off the money. Stand on principle and the American people will get behind them. I’m tire of the Republicans taking this lying down.

Well, Steve, can you blame them, considering that the only people eligible to get these waivers will be the close relatives – children, parents, siblings, etc., of US citizens whose only violation is that they’re here illegally – nothing else (they didn’t enter illegally, they’re not working, they’re not convicted of any crimes). Under current law, if a citizen’s parents visit and decide to move to the US, but overstay their visa by a day, once they leave, they cannot re-enter for at least 3, and as much as 10 years. And they have to leave to get their visa extended.

No, Steve, in a lot of cases they don’t know that if they overstay their visa by a single day, they can be excluded from the country for 3 years. And we’re not talking about hard-core illegals here, the people who knowingly snuck into the country and violate our laws indiscriminately once here. We’re talking about people like students and tourists who have family here already, US citizens.
A very small group, but someone didn’t bother to read the details, and instead misled you guys about the meaning of this particular program.

Of course that depends on how many people legal aliens are in the country, I would say there are quite a few and there is the potential for a large amount of people to be eligible for the waivers.

Okay, so you’re just winging it too.
Steve, you should really check into these things before posting opinion about them.
These waivers are proposed for people unlawfully in this country who have close family who are US citizens. That reduces the population of potential eligibles a lot.
Of all the potential barriers to them getting legal entry, like illegal entry, or being convicted of a crime, or working illegally, or being in the country unlawfully, if a person has more than just “unlawful presence,” they’re not eligible for the waiver.
And using already-defined standards, the US citizen they’re related to (parent, son, sibling, etc. – I think it includes grands) must suffer extreme hardship as a result of their absence. If that extreme hardship cannot be proved, they’re not eligible for the waiver.
Those standards and restrictions make the population of people potentially eligible for the waivers pretty small.

I am one of those who say I won’t vote for Romney, but then I think about the possibilty of Obama getting to SCOTUS nominations and I realize I must once again hold my nose and vote. But it is damn frustrating to say the least.

Um, has anyone actually read the proposed rule regarding these provisional waivers?
They’ll only apply to people already in the system, working on legalizing their status, whose only bar to receiving legal status is that they were here unlawfully – for instance, the student or tourist who overstays his visa. By and large, the people who deliberately enter the country unlawfully would automatically be ineligible for this waiver, because they would have more than just the “unlawful presence” bar preventing their legalization. Likewise, illegal immigrants who work illegally wouldn’t be eligible for this waiver because they have additional bars to their entry (working without authorization). Those who are convicted of crimes, of course, also have additional bars to their lawful entry that would render them ineligible for the waiver.
What happens is this – someone in the country unlawfully must return to his home country and apply to the US Consulate there for a visa. Sometimes, though, they cannot return to the US for 3 – 10 years, because of the law. If they’re otherwise acceptable for entry, this waiver would reduce the amount of time they’d be out of the country.
This waiver will be available, if approved, only for those illegal immigrants whose long absence from their immediate family in the US (Parents, children, etc.) would impose a severe hardship on that family (who must be US citizens, not just legal residents). The definition of “severe hardship” remain the same.
At any rate, this policy certainly has not been implemented – USCIS only published the proposed rule with a request for commentary on March 30, meaning that there’s a long process to go through before it actually is implemented.
This proposal won’t change existing immiggration law one bit, and certainly doesn’t constitute the “end run” around the law that the conservative peanut gallery is predictably wailing about.

The one missing question here is who pays for all these people once they are given waivers? There also is no excuse to plead ignorance because a person “forgot” or “didn’t” know their visa or work permits were expired.
This country is bending over forward and taking it where the sun don’t shine just to please the guilt of progressives as well as those who profit by paying documented whatevers lower saieries which takes jobs away from American workers.
If that sounds myopic, so what. I am tired of all the whiners and enablers of law breakers be they Democrates or Repuublicans. The open border crowd are a disgrace.. They are guilty of aiding and abetting illegal activity, it’s as simple as that….WM

Proposed legislation my ass. It’s nohing more than window dressing for the legal and illegal immigration tsunami coming down the plke. We have every right to speak anecdotaly without so called facts; whose facts? Government and think tank backed bullshit facts? The facts are overloaded hospitor Cbaals and ER”s, the prison systems, schools, every municipal, county and state facility, the welfare and social security systems, motor vehcle departments. Any modicum of common sense is no longer in existence as the overloaded and bloated beurocracies at every level enforce this insanity. And make no mistake, the checks and balances of a two party system have gone the way of the most other elements of American culture and therefore rendered this tidal wave of distruction unstoppable. So then, can you guys on the left humor those of us on the right as we woefully lament the passing of this once great republic as it morphs into the next failed social experiment? But then, conversly, if and when we become the next USSR, Red China, or North Korea it will be a the latest in socialst success stories, no?

In response to TGY – That is an assumption like everything else in these bureaucratic pipe dreams. Just like more entitlments will make the economy rebound. The waiver is just another fanatasy cooked up to get votes. All I need to read is, between the lines.
Off track but in the same vien, take in to account the stupidity and ignorance of the electorate to believe everything the D.C. ass clowns tell them. A Fox poll this morning reported that the “Buffet Rule” is favored by 60 percent of Americans.
Unfortunately in their feeble minds that practice an illiteracy when it involves fact, is that Buffet himself owes almost $ 400 million in back taxes which the IRS is trying to collect – but the real Biuffet rule in his case is high priced tax attorneys who will no doubt in the end negotiate a lower settlement amount which the ignorant 60 percent and everyone else will have too pick up the balance of Buffet’s tab.
In closing the 60 percent of zombies who approve a rule which in the end produces nothing is a good indicator that there are more than enough fools on hand to reelect their messiah….WM

Right on WM- In exchange for putting the kabash on the Keystone pipeline, a move that allows Buffets trucks and trains to continue to exercise a monopoly on he movement of that oil, the Oarcle of Omaha needed only set up a phony issue for Obama to run with. Eventually a portion of the purported have nots among the koo koo for cocoa puffs 60%er’s will be kicked out in the cold by those small business owners who will no longer be able to afford them.
