Is the ATF Harassing Gun Owners in Texas Without a Warrant?

July 10, 2009

Many on the right have been waiting for the assault on the second amendment to begin. We have the most anti-gun president in the history of our country and yet we are still waiting for the attack on gun owners to begin. Or are we?

We have heard rumblings about the Mexican drug violence and how the guns being used to commit these violent crimes are coming from America. It now appears as if the administration is beginning to stealthily take on some gun owners using the Mexican violence as the excuse for harassing gun owners in Texas.

The ATF has been going door to door in Texas, questioning gun owners. They are doing this for no just cause, in some cases for no other reason than they recently purchased a gun that happens to be the same caliber that the drug lords prefer. The ATF is going into gun shops and combing through the records of recent gun sales and then harassing the people who made those purchases.

The ATF is also interviewing people about their neighbors for no reason and asking them about any “suspicious” gun purchases that their neighbors might have made.

And now comes news that when a gun that has been used in a violent crime in Mexico has been traced back to the original owner the ATF is paying that owner a visit and “interviewing” that owner. I can understand that they need to find out how that gun ended up in Mexico but there is a little problem with the way the ATF is conducting these “interviews.”

When asked whether or not they were acquiring search warrants before visiting these gun owners the ATF refused comment. In all likelihood that means that they are not getting a search warrant.

The ATF is investigating violent gun crimes and they are “interviewing” American citizens who may or may not be even slightly involved in the crime and they may not be taking the time to have a search warrant issued before conducting interviews with those they feel might have either willingly or unknowingly  put the gun on the streets.

What are these citizens supposed to do? If they refuse to talk to the ATF without a search warrant it will send up red flags, even if the person is innocent, but their rights may be in the process of being violated here.

So while there has been no legislation and seemingly no action being taken in Washington to curb the rights of gun owners it does appear that there is something fishy and unconstitutional going on in Texas to gun owners.

The ATF was out in full force without probable cause and without justification already and now it appears when they do have probable cause they are not following the proper procedure and acquiring a search warrant.

It’s harassment. No sane criminal would fill out the paperwork in a gun shop to later use that same gun in a crime or sell it to another criminal.

Wish the ATF would chase the criminals rather than apparently law-abiding citizens.

Good point, we are supposed to believe that the people who are supposedly suppling the guns to Mexico are going through the process of legally buying the guns. That just does not make any sense. They would never leave such an obvious paper trail.

I’ll be the optimist and suggest the there must be at least some in the ATF who disagree with Obama’s gun philosophy. They just might be putting on a show for Obama’s consumption. There must be some level headed people left in the various government agencies.

Shut up FRED. You’re a loudmouth without a clue.

And take TEXAS off your self-appointed name.

Texas does NOT and never will endorse a bumblin’ idiot like yourself. You are not a real Texan and you make the rest of us Texans look retarded.

I heard 2 callers call in to the Walton and Johnson show and say that they had been visited by ATF…the first caller said they did have a warrant but he did not say what the PC (probable cause) was on the warrant which is required so a judge will have good cause to sign the warrant. The caller also did not say what law had been broken which is also required to be on the warrant. This is very bad for America. I would suggest all Texas Patriot Americans flood their representatives with calls and get as much Media involved as possible and start posting their experiences on the internet….all that read this column should also spread the word about this….this is a very important development.

I ain’t buyin’ it. Some of you guys are gullible as hell. There is just no way the amount of supposed harassment is going on that some believe. Too anecdotal, too convenient. Try to broaden your horizons beyond a couple degrees over the far right once in awhile.

Look, I’m not saying NONE of this stuff goes on. What blows me away, tho’, is how people extrapolate a few isolated incidents (for many of which the veracity is quite questionable) into some “bogey man” end of the world as we know it scenario. It just doesn’t add up.

There are legitimate reasons why the ATF may be pursuing some actions of this GENERAL nature, and of course there are always abuses of power by any particular group of people who wield it. But that doesn’t mean that it’s evidence of more onerous intent by the highest powers on earth.

This a great country, and I personally do not believe your freedoms are not in any sort of jeopardy approaching what your supposed vigilance would lead you to believe.

I know, I hear you already. I’m ignorant and naive. And you are doing me a favor buy watching over our freedoms whether I believe this conspiracy stuff or not. Maybe so. But I doubt it.
