Obamacare may be headed back to the Supreme Court
Today the Supreme Court reinstated a lawsuit to Obamacare which had been previously thrown out by a lower court. This means Obamacare is back in the court system and will likely make it all the way back to the Supreme Court sometime next year.
The issue this time around is the constitutionality of the contraception mandate as well as the mandate that all companies which employ 50 or more people be required to offer approved and adequate (according to the government) healthcare insurance.
I have one question about this issue and it is a simple one, what’s the point?
The Supreme Court has already ruled that the federal government’s taxing authority grants it the right to force American citizens to buy healthcare insurance simply as a condition for living in this country, so it seems to be a natural extension of the law that the federal government can also dictate to employers they must offer insurance to the people. And it also seems a natural extension to the precious Supreme Court decision that the government can force private insurance companies to provide certain benefits in their insurance plans.
If the federal government can force the people into commerce than certainly it can dictate what must be included in that same commerce. Such is life in the new America so if I were you I wouldn’t get my hopes up that there is even the slightest chance the provisions will be struck down.
The American people accepted Obamacare as the law of the land when they reelected Barack Obama, the 2012 election was our last chance (even if it was a slim chance) at getting rid of this disastrous legislation once and for all and the American people decided to forego any real attempt at repealing Obamacare and now we must all live with the consequences of the last election.

Perhaps if insurance premiums weren’t so out of this world and were affordable, people would get health insurance on their own. I think insurance companies are also some to blame. I already live below the poverty level. What’s next? Fines and/or jail time because I can’t afford hundreds of dollars in insurance premiums every month? Making me pay a fine I already can’t afford? Guess it will be jail then.

At least before you had a choice not to buy something you couldn’t afford, now you don’t. And with Obama mandating these insurance companies provide more benefits what do you think is going to happen to the premiums?

It frightens me. How is it that you will be fined? I had heard you would have to send in paperwork with your tax returns proving you have insurance or you would lose your tax return. Heard anything like that? Is there any truth to that?

Yes, I have heard that the forms will be included with your tax returns. From what I have heard people are going to be stunned when they find out how complicated the new returns are going to be after this goes into effect, I don’t know how true it is. We will just have to wait and see.

It sure would be, I just am not going to get my hopes up because I honestly felt the individual mandate would be thrown out. I know SCOTUS has ruled but I still believe with all my heart that it is unconstitutional.

Steve, that is precisely what made Justice Roberts Ruling so brilliant. He said that it absolutely does not qualify under the Commerce Clause and that it only works because it is a TAX!. This bill is unconstitutional because Tax bills must arise in the House and this bill arose in the Senate. This issue is currently wending its way thru the system and will probably be heard in the Spring. Nobody but Fox News is reporting this in the MSM,but it has been news in other sources since July. This thing is in no way over yet.

I wish I could share your enthusiasm, Chip. Unfortunately, I can not. After the Supreme Court’s decision earlier this year, I hold zero hope that this law will ever be overturned. Even though it is plainly wrong, I will also be surprised if the contraception mandate is not upheld. I have no faith in the court, even though they supposedly have a conservative leaning.

I have heard there is a challenge to the constitutionality of the legislation because it wasn’t begun in the House but I believe once the House signs off on it it is all a moot point, we shall see but like Larry I would be surprised if this ever gets overturned.
