Could Obamacare lead to property seizures?

January 26, 2014

Kudos to Jim over at Asylum Watch for catching this story which has not surprisingly not been covered by the mainstream media. It appears as if Obamacare sets the stage for more property seizures by the Federal government.

How is this possible? It has to do with the Medicaid expansion which is part of the healthcare reform law:

Obamacare requires everyone to have health insurance. In more than half of the states in the country, that comes through an expansion of Medicaid, the joint federal-state program for the poor. Under a 1993 federal law, states can recoup the costs of Medicaid by seizing the property of deceased Medicaid recipients.

With the vast expansion of who can enroll in Medicaid under Obamacare, that could mean significantly more property. Though The Washington Post called it “scary but improbable,” the newspaper reported there are people who are concerned about it and that the federal government has not rejected it out of hand.

The Washington Post calls it improbable but the Federal government has not ruled it out, doesn’t that make you feel better about this? The Congress passed this law in 1993 to help deal with the rising costs on Medicaid:

Out of a concern over exploding Medicaid costs, Congress passed a law in 1993 that states must try to recover money from the estate of people who used Medicaid for long-term care. It further gave states the option to target the estate of all Medicaid recipients for any benefits they received after routine care.

And with the expansion of Medicaid under Obamacare the costs can naturally be assumed to skyrocket, the Federal government will need to recoup this money somehow and we are supposed to believe this will not be an option? Be afraid, be very afraid…..

Don’t worry, if the state ‘petty officials’ fail to step up and confiscate Grandma’s house when she dies, those lovely ‘friends and neighbors’ over at the IRS will be more than able to help Barney Fife do the heavy lifting.

But seriously, this demonstrates with scary facts one of the great changes that will have to happen if this Republic is to survive and pass her greatness onto future generations. There are so many laws, so many hundred and hundreds of thousands of laws, that there is not a single voting age adult alive who is not in violation of some law, even if they are interpreted with reason. And to a power hungry elite (money/wealth/property are the basis for growing power) interpreting laws can stray many miles away from reason. To survive, all of the laws will have to be brought out, one at a time and scrapped or reduced and a simple code of law will have to be instituted.

Richard Maybury has a brilliant quote I modified slightly and use as the tag line on my emails. He said, ‘Do all you agree to do, do not encroach on another’s life or property’. He said that all of torte, civil, and criminal law can be summed up in those statements. I think he is about 99.999% perfect on that.

The incomprehensible mountain of laws can not be understood, even by many lawyers. This is scary, but those who love freedom will always find ways to rise above the morass of stupid and succeed, right up until the government encroaches on your life and/or property.

The news glibly reported that 40,000 new laws were taking effect this year if you count federal, state and local, AND NOBODY CARES! Politicians stay in office telling how many NEW laws they have passed.
They call this a do-nothing congress. GOOD! GREAT! I would be happy if they never did more than pass a budget and went home.

Thanks for the bump, Steve. It really is scary what this administration is capable of doing.
