The IRS agrees to hand over all of Lois Lerner’s emails
As you all know by now the House voted to hold Lois Lerner in Contempt of the Congress yesterday. As I wrote here I was opposed to this decision because, in addition to my Constitutional concerns, I felt that this was not the best way to get Lois Lerner to talk. I felt at that time that the House would have been better off granting Lois Lerner immunity because it would have freed her up to talk and her testimony could quite possibly lead to people higher up in the Obama regime, because I feel the targeting order came down from the highest levels of the Obama regime.
However, just one day after the Contempt vote the IRS has decided to hand over all of Lois Lerner’s emails related to the scandal. More can be read here.
The IRS has finally agreed to hand over all of ex-IRS official Lois Lerner’s emails to the House Committee on Ways and Means, The Daily Caller has learned.
New IRS commissioner John Koskninen previously said that it could take years to provide all of Lerner’s emails to congressional investigators. But Ways and Means’ referral of criminal charges against Lerner to the Department of Justice, coupled with the House of Representatives’ holding Lerner in contempt of Congress Wednesday, has changed the tenor of the investigation into the IRS conservative targeting scandal.
I still have Constitutional concerns about Federal politicians being able to decide a person has waived a guaranteed right, but from a tactical standpoint it seems to have worked.
In the wake of the Contempt vote documents which we were once told would take years to produce are now suddenly going to be much easier to release than we were led to believe. Is this not proof the IRS and the Obama regime has been stonewalling this investigation?
It remains to be seen, however, how heavily redacted these documents are; if the Congress gets nothing but what amounts to hundreds of blacked out pages it really is not going to do any good, is it? And we have seen this before…..

So much for that Smidgen thingy. Just heard on Megyn Kelly that the IRS is auditing the Tea Party donors to the tune of 10 percent as opposed to 1 percent as average auditing of the filers.

Maybe Lerner will be the loose brick. I’ll go along with immunity in exchange for rolling over, but it seems Congress has already turned it down.
I’m a little curious about the whole idea of waiving 5th Amendment rights. How does saying anything cause you to give up the right? If she does nothing except sit there in silence, in the face of all questions, comments and requests, she could actually make herself into a martyr.
Would even our Congress be dumb enough to play into that one?

The idea that politicians can decide a person have waved their fifth amendment right is something that really bothers me. What is to stop them from using this in the future against the American people?

I was always of the opinion that you could enforce your 5th Amendments rights by simply shutting up. The applicable portion of the text is pretty simple. There’s a exception about due process of law, but I have a hard time conceiving that answering a single question nullifies the right.
“…nor shall be compelled in any criminal case to be a witness against himself,…”
I know there’s an exception for Grand Juries. Even though it’s very limited, it always bothered me.
Ultimately, she will always have the power of: I WON’T
Using rubber truncheons on her in public will defeat the politicians purpose.

Yes, we have seen this before. I will believe these emails contain real and substantive information about the IRS targeting conservative groups when I see it in black and white. If there is one thing this administration is good at, it is at obfuscating and obscuring the truth.
