The Congress declares itself a small business (and lies about its number of employees) in order to qualify for Obamacare subsidies

  I have written many times in the past about how the Republicans and the Democrats are really on the same side–the establishment side–and about how they put on a show for the American people using the Hegelian Dialectic of thesis/anti-thesis/synthesis to make it appear as if we have a real choice in the elections. The dialectic goes something like this: create or take advantage of a crisis, create the opposition to the crisis in order to control both sides, and then use the controlled chaos as the two sides battle to implement the predetermined solution.

  A perfect example of this is Obamacare: the Republicans love to run campaigns based on the promise of repealing Obamacare but when they had the chance to defund the healthcare program what did they do? The Republican controlled House can cut off the funding any time it wants to and yet the program remains funded, why is that? 

  In my opinion, which I have stated before, it has always been simple: the Republican establishment is not really interested in repealing Obamacare because they find it to be a winning campaign issue. They have made the political calculation that they can win elections on the promise of repealing Obamacare and they are going to continue to do so until it is no longer a winning issue. If they were actually to defund the program they would lose a campaign issue and they would rather make it look as if they are trying to repeal Obamacare and failing than they are in actually defunding it and making good on a promise. 

    However there may be more to it than that, and it might actually be even more insidious, because according to this story, both the House and the Senate declared the Congress was a small business in order to qualify for Obamacare subsidies using the District of Columbia Small Business Exchange.

  As ludicrous as it is that Congress can declare itself a small business in order to take advantage of a policy it created it gets even worse because the DC Small Business Exchange only allows businesses with fewer than 50 employees to join and we all know both the House and the Senate have more than 50 employees. So how did the Congress qualify even if we grant it the premise that it is a small business? Simple, they lied about the number of people employed by the Federal government in Washington DC.

Both the U.S. Senate and House of Representatives certified that they had only 45 employees each in order to sign up for the District of Columbia’s Small Business Exchange. But 12,359 – or 86 percent of the exchange’s enrollees – are members of Congress, congressional staff members, and their spouses and dependents, according to an appeal filed with the D.C. Court of Appeals by Judicial Watch.

The public interest law firm announced Monday that it is appealing the February dismissal of its lawsuit challenging congressional participation in the Obamacare exchange even though the D.C. Exchange Act limits enrollment to small companies with 50 or fewer employees.

“Congress obviously has far more than 50 employees,” Judicial Watch attorney Michael Bekesha pointed out in his opening brief. “It has thousands of employees.”

Congress enrolled in the small business exchange when its previous coverage under the Federal Employee Health Benefits plan was terminated by the Affordable Care Act (ACA) and congressional employees stood to lose thousands of dollars in “employer contributions” if they enrolled in the District’s individual exchange.

According to documents obtained by Judicial Watch through the Freedom of Information Act (FOIA), the U.S. Senate and the U.S. House of Representatives both certified that they “employ 50 or fewer full time equivalent employees.”

  So both the House and the Senate claimed they only had 45 employees each, and if my math is correct that is a total of 90 employees, and yet over 12,000 people employed by the Federal government managed to enroll in Obamacare and this has already been dismissed by the courts once? The fix is obviously in and anyone who listens to the Republicans when they promise to repeal Obamacare is being played for a fool and honestly if you read this story and still think there is a chance for Obamacare to be repealed than you are a fool. Stop listening to what the politicians say and start paying attention to what they do.

      That was pretty much my first reaction when I read the story earlier today, this is outrageous and yet we let them get away with this shit. It is so damned frustrating!

      I guess the Government can be anything they want it to be, not unlike a hooker that someone pays for services….about the same screwing one would be getting in either situation.

        It is frustrating, Steve. The government knows the People can’t do anything to stop them. We are powerless because we gave up our power to the government, political parties, special interests, corporations, and the very wealthy. The People allow themselves to be controlled and ruled and violated because they just don’t know any better. They don’t know that all the power to govern resides within the individual – if they would just use it!

    Ok then, they are finally coming clean and they do not give 2 sh*ts whether we care or not…what is new? We find something out and they say “so what”! They are going to take care of them first and if any of the residual effect trickles down to us, well, guess we are just lucky and should thank them for all their hard work (ya right). They are quickly turning into what we so dislike in this president, liars!!!!! Guess it goes with the territory of DC? The middle class are the ones that are getting the screws and we are supposed to be thankful that it is not worse than it is. I don’t know about the rest of you, but we are quickly running out of extra money that we can afford to turn loose of for the “do nothings”, but still we will be shaken down for it.

      You are 100% right Lou, they do not seem to care what we think anymore. At least the establishment doesn’t, they are all part of the I know what is best for you crowd and until we vote them out nothing is going to change. They need to be sent a clear message!

    Ha, after watching the live feed of Ferguson the last few days and having just been down on those streets last Tuesday, I have to post this video…you gotta love this guy, he posts alot and is just plain funny..

      Last year outside School Stadium in Newark I saw a guy struggling to get out of his car and when he was finally able to eject himself and his crutches his pants were down around the crack of his ass. He proceeded to waddle down the street unencumbered by the rediculous picture he created for all to see. Ya can’t make this shit up.

    I thought they ‘exempt’ themselves and their staff from Baloneycare?
    2013 ‘Is Congress Really Attempting A Last Minute End Run To Exempt Itself From Obamacare?’ “The only health plans that the Federal Government may make available to Members of Congress and congressional staff with respect to their service as a Member of Congress or congressional staff shall be health plans that are — (I) created under this Act (or an amendment made by this Act); or (II) offered through an Exchange established under this Act (or an amendment made by this Act).”
    Sure is confusing. Except for the fact that they’re getting their treats, one crooked way or another crooked way.

      Yeah, I am not sure what happened but somewhere along the line they pulled this fast one and they snuck it by us. At least Judicial Watch is on this, we’ll see what happens but I am not expecting much.

        Glad I am not the only one that thinks the Chemtrails are real! You mention that to people and they look at you like you are stupid (I actually have a high IQ, but guess that doesn’t count anymore)….after all it is just the exhaust of the jets….hmmmm!

      I doubt any of us here believed that Obamacare would ever be repealed. I know they say they will, but how much do we think they are telling us the truth anymore? I hate to be lied to and in my “old age”, I am becoming cynical. That is not necessarily a bad thing!

      It is all a game to them but there are still people out there who think Obamacare can be repealed and they are only fooling themselves. Even if the Republicans really wanted to repeal it it would not ever happen.

        I have to agree. It won’t be repealed simply due to the individual mandate that creates a mandated market from which the special interests can profit. Maybe we’ll see some parts and pieces that are pro-consumer repealed in the future.
