Bryan Pagliano will plead the Fifth during Judicial Watch testimony over Hillary Clinton’s email scandal
Yesterday longtime Hillary Clinton aide, Cheryl Mills, testified under oath over the former Secretary of State’s email scandal and it was pretty damaging testimony. You can read more about that here. Next up for Judicial Watch appears to be Bryan Pagliano. Mr. Pagliano is the man who set up Hillary Clinton’s personal email server and he was also in charge of maintaining it so his testimony would be quite interesting to hear. But we will not be hearing it…
Just as he did when he testified in front of the House Benghazi Committee Bryan Pagliano is going to plead the Fifth. In addition to this his lawyers are asking that his testimony is not video taped. Here is more:
“Mr. Pagliano will invoke his right under the Fifth Amendment and decline to testify at the deposition noticed for June 6, 2016. Given the constitutional implications, the absence of any proper purpose for video recording the deposition, and the considerable risk of abuse, the Court should preclude Judicial Watch, Inc. … from creating an audiovisual recording of Mr. Pagliano’s deposition,” Pagliano’s lawyers Mark MacDougall and Connor Mullin wrote.
“Judicial Watch may move to unseal the materials at any time. Furthermore, in the event of a leak or data breach at the court reporting company, Mr. Pagliano would be hard-pressed to prevent further dissemination and republication of the video. Given that there is no proper purpose for videotaping the deposition in the first place, Judicial Watch’s preference should yield to the significant constitutional interests at stake,” Pagliano’s attorneys added.
This of course his his Constitutional right but it is interesting because Bryan Pagliano has already been granted immunity from the FBI and from the State Department. Did that immunity agreement only cover the FBI investigation or does it also extend to the Judicial Watch investigation? I don’t know the answer to that question but I would guess his lawyers were smart enough to work out a deal to cover him in any and all possible investigations.
If the immunity deal does not extend to the Judicial Watch investigation it is not surprising he would plead the Fifth after having done so once before, if however the deal does extend to this case it would appear as if self-incrimination is not what he is worried about, but rather he is worried about incriminating Hillary Clinton.

Exactly! He knows what could happen to him if he says anything. It is self-preservation he is interested in, not self-incrimination. I wish I had thought of that when I wrote the post. 🙂
