Federal judge rules DACA illegal
This is just starting to come over the wire as I write this but it is being reported here that a Federal judge has ruled DACA is illegal because the Congress never granted Barack Obama the authority to create immigration law. Here is more:
A federal judge in Texas on Friday invalidated an Obama-era initiative that provided deportation protections and work permits to some young immigrants, a ruling that places the program in jeopardy.
U.S. District Judge Andrew Hanen ruled the Deferred Action for Childhood Arrivals program was unlawful because Congress never gave the executive branch the power to grant mass reprieves to immigrants who are in the U.S. without authorization.
Judge Hanen’s ruling barred the Biden administration from approving new DACA applications, but the judge stayed the immediate effect of his ruling on current DACA recipients.
The judge issued a stay of his decision for those who have already been approved previously but has banned new approvals moving forward and this seems like the proper decision.
The problem most of us have had with DACA was with the overreach of Executive Authority and this decision and not necessarily the program itself and this decisions reaffirms our concerns. Of course I think we all know this is not over by a longshot.

LOL! Historically, the Conservatives have argued against Judges legislating from the bench with oddball legal theories. The fun now is seeing the Libs say the same thing when judges rule against them. You won’t have to look far to find the Lib articles talking about it.
While our government leadership seems intent on our destruction, favorable court rulings and Liberals getting attacked by other Liberals is adding up. More and more ordinary, even Liberal people are starting to realize that Liberalism has morphed into the new Fascism. There’s a recent article by a lesbian feminist speaking of harassment from the trans community and another one by a gay man getting flack because he outwardly presents as masculine.
Some people are waking up.

Funny, even in those communities there is a stereotype of how people should act I guess. Apparently if you are gay you cannot be masculine according to other gays, and I though straight people who said that were homophobic…
There are so many groups out there now which have been created by the left that in order to get enough attention for themselves they have to turn on the other groups, the division the left has been sewing is finally starting to come back to bite them on the ass.
Of course the left is going to use “activist judges” as an excuse to try to pack SCOTUS!

Long ago Progressives came to the realization that they could not get their progressive and anti-liberty agenda passed through legislative means. They looked to the courts to dictate policy. That blade cuts both ways. What is good for the goose is good for the gander. Shoe on the other foot logic. Maybe now they will pay attention when conservatives talk about legislating from the bench. But I am not holding my breath. For progressives it is never about principle. It is all about power. Absolute power.

You got it nrringlee and Dr Jeff mentioned it as well. That is an angle I missed when I was writing the post but it is a great point. Suddenly the left is going to be against “activist judges” not that they opinion goes against them and I think we’ll see them use this as an excuse to try to pack SCOTUS.

We on the conservative/liberal/libertarian side are bound by principles. Progressives and leftists are bound by ideology and ideology is the foundation of their quest for power. That is why we are a house divided, in Lincoln’s words. Until we all start operating from a common foundation we will founder as a nation.

All sad but true. Now, if they would get rid of sanctuary cities and all of the other illegal offerings of the far left administrations, we might actually be acting like we live in America and follow our own Constitution.

I still remember when Trump said he was going to send illegals to the sanctuary cites and they all balked at the idea. Trump called them out on their hypocrisy and they showed their true colors. I sat that should still go, let them all create their own little Utopias and see how long they last.
