Gunrunner: Darrell Issa to sue Eric Holder on Monday over Fast and Furious documents

 It is now being reported here that tomorrow Darrell Issa will sue Eric Holder in civil court in a last ditch attempt to finally get his hands on the documents Eric Holder has gone to great lengths to hide.

The committee expects to file the civil contempt suit against the attorney general Monday,” a Republican source said. The suit will be filed in the federal district court for the District of Columbia

  As regular readers of America’s Watchtower already know, Darrell Issa and the Oversight Committee found Eric Holder in Contempt of Congress for failing to comply with a subpoena request for documents which I suspect tie the embattled attorney general directly to the Fast and Furious scandal, and immediately following this vote Eric Holder ran to Barack Obama and begged him to seal these documents using executive privilege. Not wanting this to come to a head before the election, Barack Obama naturally obliged putting politics ahead of justice.

  Darrell Issa is now taking the next step and I for one couldn’t be happier that he isn’t going to back down after coming so far. Just when we thought the investigation might have been effectively killed by the man who promised to have the most open, honest, and transparent administration in history it looks like it might be heating up again.

    The Democrats will claim this is election year politics. They will conviently forget how long Issa has been trying to get Holder to cooperate. Let’s hope Issa gets an honest and forthright judge who will demand to see the documents to decide for himself is executive privilege should apply.

      That is exactly what the Democrats will say, but they forget that if the Obama regime hadn’t stonewalled this investigation from the beginning it would most likely already be over. Eric Holder is to blame for stretching this into an election year.

    What good would that do?

    Following a contempt citation, the presiding officer of the chamber is instructed to refer the matter to the U.S. Attorney for the District of Columbia; according to the law it is the “duty” of the U.S. Attorney to refer the matter to a grand jury for action.

    I’m sure that will happen! Holder has been so attentive of his duties so far.

    Under Article II, the principal duty of the President is to execute the law; that, under Article I, the law is what the lawmaker—e.g. Congress, in the case of statutory contempt—says it is and the Executive Branch cannot either define the meaning of the law (such powers of legislation being reserved to Congress) or interpret the law (such powers being reserved to the several Federal Courts); any attempt by the Executive to define or interpret the law would be a violation of the separation of powers; the Executive may only—and is obligated to—execute the law consistent with its definition and interpretation; and if the law specifies a duty on one of the President’s subordinates, then the President must “take care” to see that the duty specified in the law is executed. To avoid or neglect the performance of this duty would not be faithful execution of the law, and would thus be a violation of the separation of powers, which the Congress and the Courts have several options to remedy.

    Obama’s done such a great job of this in the past and I’m sure he’ll get right on it!

    I’m sorry to use Wiki’s for information but this has been fruitless to this point. This Administration, from top to bottom belongs in a Federal Penitentiary!

      Ronald C. Machen Jr. was nominated to serve as United States Attorney for the District of Columbia by President Barack Obama on December 24, 2009. Mr. Machen’s appointment was confirmed by the United States Senate on February 11, 2010.

      YOu are right, and he refused to move forward with the contempt chanrges, but this is a civil suit and I believe Issa can move on this directly. THe only question is, who is presiding over the court the appeal will head to. Being in DC we may find this goes nowhere.

      Phillip, it is just a bad situation that we have found ourselves in this position. I am sure that AG Holder is playing a waiting game and figures he will come out clean in the end. We know he figures that Obama has his back and so far he has had. Hopefully there will be a glitch that will come along whether it be a Whistleblower or some legal formality that will take this crook down. We know that it is a big game to them, but we also know that most people here in America are becoming aware of what has happened and that is no thanks to the Media, but to blogs like this on the internet that have circulated it. The ACE for them will be a judge that can be bought OR blackmailed.This could not have happened at a better time and I bet the White House is scrambling right now.

      Do you know how silly that sounds? However, I would not put it past them to try and spin it as such. They always have the fall back of Bush, but that might have been worn out.

        Satire is meant to sound silly. Thankfully this cancer in the WH has provided a lifetime’s worth of satire in a mere 3 1/2 years.
