Eric Holder believes Barack Obama’s agenda is more important than the constitution

December 15, 2010

While reading this editorial in the New Hampshire Union Leader, I stumbled upon a quote that Attorney General Eric Holder made in a Washington Post column that I found both interesting and extremely disturbing. Eric Holder wrote a column in which he stated that the constitutional challenges facing ObamaCare would have devastating consequences if the challenges were allowed to succeed, but that is not what I found to be the most troubling quote from the column that the Attorney General wrote.

That distinction belongs to the following quote:

“Without an individual responsibility provision, controlling costs and ending discrimination against people with pre-existing conditions doesn’t work. The legal arguments made against the law gloss over this problem . . .”

What Eric Holder calls the “individual responsibility provision” is more commonly known as the healthcare mandate that requires all Americans to purchase healthcare coverage. This is nothing more than a term that he considers to be a more politically correct way to refer to the government’s demand that United States citizens purchase healthcare coverage.  The legal challenges gloss over the problem? In other words it doesn’t matter if the bill is constitutional?Eric Holder is trying to make the argument that constitutional concerns are trumped by Barack Obama’s agenda. And this is the top attorney in the nation?

He does not believe that the constitutionality of this legislation is important because he believes it addresses a problem that is more important than whether or not Barack Obama’s solution to the problem is constitutional or not. He feels that Barack Obama’s radical agenda is more important than the constitution.

Thankfully Judge Henry E. Hudson did not think that was the case when he ruled that the healthcare mandate was unconstitutional:

Despite the laudable intentions of Congress in enacting a comprehensive and transformative health care regime, the legislative process must still operate within constitutional bounds

While the courts seem to have been infiltrated by liberal, activist judges, it is refreshing when a justice actually looks towards the constitution before ruling in a case, and that is exactly what Justice Hudson did. While claiming that the Obama regime and the Congress had good intentions, he ruled that that doesn’t mean that good intentions are all that it takes to pass a law. A law still needs to pass the constitutional test and in his opinion the healthcare mandate did not solve the problem through constitutional means.

As Attorney General of the United States Eric Holder should understand this basic tenet of American constitutional law, but sadly he does not. This statement alone should disqualify him from the top law enforcement position in the land. If he does not understand what the constitution represents, and if he feels that Barack Obama should have free reign to rule regardless of what is written in the constitution than he simply is not qualified to be the Attorney General.

It is now perfectly clear why Barack Obama chose Eric Holder to be the Attorney General; Eric Holder has about as much regard for the constitution as does Barack Obama himself.

The Congress is out of control. A sickening day. The Dictatorship ship has sailed and there is nothing that can be done. Snowe Collins et al, need to have one heck of a primary fight. Holder should be impeached. Obama as well. Good find, that only confirms what we already knew, but confirmed.

It is slipping away from us, this is going to be a SC case of the utmost import. If we lose this case there is virtually nothing that the federal government cannot do.

You hit the nail right on the head Steve. This is the mindset of all in his administration, and the reason why we must remain vigilant and protect this document that has stood the test of time.

These people are so dangerous to this country. The fact that THE Attorney General can be so flippant about the Constitution enrages me to a level I thought had fizzled into numbness a year ago.

I know! This man is supposed to be an enforcer of the law and of the constitution but he just doesn’t give a damn about the constitution. This man has no right being the top law enforcement person in the United States. It is sickening!

How dare you Steve? Don’t you know our Presidente is a Constitutional Law Professor – are you suggesting you know more about the outdated piece of paper than he does? Considering he thinks there are 58 states, I would argue my 10 year old know more about the Constitution than Obama.

Holder may be a busy man defending himself the next few years. Investigations are already on the agenda, and he will be right in the middle of it.

Wrong, fleeceme. Obama said 57 states. Well, 58 if you include Puerto Rico I guess.

Actually he said, “I’ve been to 57 states, we got one more to go.” Not that it really matters, anything above 50 is pretty freaking sad.

I have to agree with fleeceme on this one, Barack Obama did claim that he had been to 57 states but still had one more to visit.

Excuse me, but don’t these people swear an oath to defend and up-hold the Constitution? And if they did, isn’t it a crime what they are doing? I think I’m going to be sick.

I think that it is, but there is now way he will ever be impeached.

I know we can’t impeach Obama… but can’t we impeach Holder? Or force him out of office somehow? Reason: Gross incompetence. Getting rid of someone who’s guilty of this kind of criminal ignorance would deprive Obama of one of his tools.

I think there are plenty of reasons to impeach Holder, I guess we will have to see what happens when the new Congress convenes.

As Steve said, ‘a fool with power’… That sums up the entire Obama administration.
