Arizona files a countersuit against the federal government over illegal immigration

February 11, 2011

As most people in the United States already know, last year Arizona passed a new “controversial” immigration law which is being challenged by the federal government. During this challenge the court ruled that Arizona must stop enforcing the most “controversial” aspects of this law. And up until yesterday there had been no new developments to this story.

But yesterday that changed when Arizona Governor Jan Brewer filed a countersuit against the federal government, claiming that the federal government has failed to control Arizona’s border from the “invasion” of illegal aliens. Arizona’s reasoning for passing the original bill that started this controversy was their belief that the federal government was not living up to expectations when it came to enforcing immigration law and yesterday Jan Brewer finally acted on that belief stating:

Because the federal government has failed to protect the citizens of Arizona, I am left with no other choice

A spokesman for the Department of Homeland Security took issue with this countersuit claiming that Jan Brewer was ignoring the facts:

Not only do actions like this ignore all of the statistical evidence, they also belittle the significant progress that our men and women in uniform have made to protect this border and the people who live alongside it

However a recent report from the U.S. Customs and Border Protection showed us that it was actually Janet Napolitano who was ignoring the data when she claimed that the Department of Homeland Security had “effective control of the great majority” over the borders.

The federal government has been derelict of its duties to enforce the borders against illegal immigration–and this isn’t anything new, both Democrat and Republican presidents have been more than willing to ignore this problem for different reasons–and meanwhile border states such as Arizona, and the residents of those states have been the ones who have felt the ill effects of this non-enforcement.

One state finally had enough and decided that it would do what the federal government had failed to do, and for that the federal government filed suit against the state. It is odd that by doing so the federal government has sided with the law breakers who enter this country illegally, while opposing a state which was doing nothing more than trying to follow the letter of the law.

Jan Brewer is not shaking in the shadows of the federal government, but is instead taking the offense once again as she looks to solve a problem that the federal government is afraid to even acknowledge exists in the first place. Kudos are in order for the governor for she is showing that she has what it takes to combat both the problem of illegal immigration and the federal government, who through its actions is actually exacerbating the problem and encouraging people to continue crossing the border illegally.

Great news. They can start with this, and then prosecutors in Arizona can start indicting administration officials for aiding and abetting.

It is a sad day that a state must sue the Feds because they are not doing their job.
