Barack Obama agrees to let states opt out of Obamacare, or does he?

February 28, 2011

Obama offers states flexibility on healthcare.

That is the headline that appeared on the Drudge Report earlier today. At first glance it would appear as if this was a softening of Barack Obama’s earlier position as it would allow states to “opt out” of Obamacare if they saw fit to do so. On the surface this looks like a major concession and a step in the right direction, but once you read the article is becomes quite obvious that the “opt out” provision comes with a strings attached–and major ones at that–because in order for a state to be eligible for the “opt out” option that state would have to meet standards which are at least equal to the original healthcare law that the states are opting out of in the first place.

To gain new powers, states would first have to convince Washington that their plans would cover as many people, provide equally affordable and comprehensive care and not add to the federal deficit.

What he is doing here is making it appear as if he is granting states their tenth amendment rights–when in reality he cannot grant this right because it is guaranteed in the constitution, it is not his to grant–but in order for the states to exercise those rights they would basically have to implement their own version of the federal healthcare law. He is trying to appease us “tenthers” by making it seem as if he is acknowledging a states right to legislate issues which are not granted to the federal government by the constitution, but this is so transparent (at least he is finally being transparent on something) that anyone who is paying attention can see through this. What good is an “opt out” provision in the healthcare reform law if a state must meet or exceed the conditions laid out in the federal law? What he is doing with this new condition to the “opt out” legislation is simply shifting the implementation of his healthcare law to the states which decide to opt out, but they will still have to abide by the federal law so in reality nothing has changed.

Barack Obama has basically admitted as much in private when he called some Democrats earlier today, claiming that this provision would end up allowing “more expansive” healthcare plans than the federal law can provide as currently written. Once again, Barack Obama is engaged in doublespeak: on the surface he is offering to allow the states to opt out in order to give the appearance that states have the option to “opt out” of Obamacare while at the same time he will be instituting conditions which will make the “opt out” option nothing but a faux opt out option. States will still be forced to implement their own version of Obamacare, and the people will still be required to purchase healthcare insurance even if they do not want it or cannot afford it.

This is just more sleight of hand from our dear leader. This is an attempt by the Obama regime to lessen the case which is being made against Obamacare in the courts by trying a pre-emptive strike before the law makes it to the Supreme Court and the Republicans had better not fall for this ruse.

It seems like this is six of one and a half dozen of the other. President Obama is still playing smoke and mirrors politics with his health care law. Does he really think that the America people and the states can not see what he is doing?

That is a good way to put it–smoke and mirrors. he isn’t really changing anything by doing this but he trying to give the impression that he is. It might work with some people–those that do not understand the constitution is a limitation on government.

He knows ObamaCare is in trouble. He knows that it has been backed into a corner by the Florida Judge ruling on 31 January. Now that they are pressing the issue on whether or not they can implement it (which will be no) and they know that if they fast track this lawsuit to the SCOTUS they could lose it all. This is why they want to advance the Virgina plan because it only goes after the individual mandate. It doesn’t seek to strike down the entire monster down. I think they are starting to realize that no matter what ObamaCare is in trouble, so why not get the states to do your dirty work for you. This move is actually a way to save ObamaCare on a state level. If he can get a few of his radical left states to implement, then it takes the SCOTUS out of the picture. That’s my take on this.

That is an interesting take on it and I have a feeling you are right. He knows that this bill is in trouble so he is now trying to get the states to implement it for him, knowing that the states have the right to do so. It is a sly move but in the end it will fail…..at least I hope so.

Lies and deceptions, all around normal politics, and he thinks that we are that stupid to pull the ole shell game on us. I can’t wait till 2012 when we take the Senate and the Presidency too, and get this damn mess straightened out.

I agree,it is scary about how the unions, progressives, socialists steal and hijack the argurment and lead the sheep down a path they don’t want to go. If anyone has been watching Glenn Beck for past year, he has been right on, and I have to fully agree with him.

I like your sense of humor. “Or does he?” It’s a serious issue, but some things just make me laugh. Does Obama insult people’s intelligence on purpose, or is that just the way the words come out of his mouth?

It may be a serious issue but sometimes you just have to laugh to stop yourself from going crazy. I think he doesn’t even realize that he is insulting us because he feels as if he is so smart that we won’t even realize what he is up to.

But the MSM are heralding this as the “great one” hears his flock, and so, will bear right. Spare me.

Perhaps I’m too cynical, but I think this empty pronouncement is just one more of many ploys to 1) reassure his base and 2) convince the uninformed swathe of our populace that the left is reasonable and the right is not.

He is just hoping that 1) and 2) outnumber and outvote group 3), namely, us. It worked in 2008.

Exactly right, this is a political ploy designed to fool the populace and help him to win re-election, I just hope that not enough people are fooled by this move.

IMHO Obama’s just hedging a little here and little there while repeating the mantra “but the legislation cannot be repealed”- truth is, we’ve got him back on his heels and he’s knows it

Keep up the full-court-press, GOP congressional leadership… don’t let us down!

We do have him where we want him and he knows this otherwise he would never have made this move. We must keep up the pressure on this and not let him appear as if he is moving to the right when we know that he is not.

You know what? I actually thought that this sounded quite a bit like the PSN while I was writing this. In this case as well as the PSN, the federal government is trying to manipulate states to create a defacto federal law under the guise of states rights.
