Murdered Border Patrol agent was armed with a beanbag gun

March 3, 2011

On December 14th, 2010 a group of armed illegal aliens crossed the border and were confronted by Border Patrol agents. The Border Patrol agents confronted the illegal aliens and ordered them to drop their weapons. When the illegal aliens refused to do so the Border Patrol agents opened fire on the illegal aliens…..with beanbag guns. One illegal alien responded by firing a single shot which killed Brian Terry.

Brian Terry is now dead because he was under orders by Homeland Security not to use lethal force. This is what Brian Terry’s brother had to say about this policy:

You go up against a bandit crew that is carrying AKs, and you walk out there with guns loaded with beanbags – I don’t get it,” Terry said in a phone interview from Michigan. “It’s like going to the Iraqi war with one knife. It boggles my mind. … These guys (Border Patrol agents) are professionals; they should be able to use their judgment call on their own

Kent Terry is exactly right. Brian Kerry was put in danger by a policy which did not allow him to use his judgement when confronting armed invaders and because of this policy he is dead. Two Border Patrol agents were confronted by at least five illegal aliens armed with rifles, and DHS policy required them to first shoot beanbags at the invaders?! Because of this protocol the Border Patrol agents did not have enough time to react to the escalation of violence once the beanbags were fired and now Brian Terry is dead.

And yet we are being told by Janet Napolitano that the Mexican border is more secure than ever, and we are supposed to believe that agents carrying beanbag guns are going to protect the American people when beanbag guns were not enough to protect the agents who are protecting the American people.

This simply does not make sense and the policies of Homeland Security are the reason why we lost a Border Patrol agent last December. The Obama regime and the Department of Homeland Security simply do not take the threat of illegal immigration seriously and the fact that our agents on the border are equipped with beanbag guns is proof of that.

If we are simply putting agents at the border and we are handcuffing them with rules of engagement which are putting them in harm’s way with no real way to defend themselves there really is no reason to have them there at all. If this is going to be the policy then it is time to get them all off of the border; if DHS is not going to admit how dangerous the border is, and if DHS is not going to allow our agents to use the tools at their disposal to reign in illegal immigration there is no use in having them there at all.

While the illegal immigrant who shot and killed Brian Terry is responsible for his death, the Department of Homeland Security is an accessory to the crime because of the policies which put him in more danger than he would have otherwise been in if not for this outrageous policy.

I agree totally ‘cept that I’m a bit more accusatory! Not only Napolitano but Holder and Obama as well need to be held accountable; they should all 3 resign …. NOW!

Janet Napolitano has NO business being in charge of DHS, and needs to be removed immediately. All she is doing is the administration policy of quietly looking away at the illegal future voters who are slipping across the border, and they chalk up “collaterial damage” for the troops in the fields. This irresponsibility of duties, from the President on down, needs to be rectified in a bad way.

I will keep my comment subdued out of respect for Brian Terry, but I will say this. Requiring any law enforcement official to go into a confrontation carrying a beanbag gun, with the other party carrying any kind of real firearm, much less assault rifles, is beyond stupid. Whoever came up with that policy should be fired.

I agree! And we will have the chance to fire them in 2012, I just wish it could be sooner than that because that is what they deserve!

It’s the same type of thing that prohibited U.S. service men and women from carrying on base. When the gunman opened his Jihadfest in Texas, nobody could defend themselves and they were killed.

Great post and great comments. Janet Napolitanao is either inept or a traitor or possibly both. This story should be headlines every where. Heads have to roll. If the president doesn’t act, then Issa should! America shouldn’t have to wait till this gets lost in all of 2012 campaign rhetoric.

Thank you! I think that Napolitano is simply incompetent, she was not qualified for the job in the first place and now we are seeing the results.

To add insult to injury, the gun used to kill agent Terry was part of an ATF program that “walked” guns across the border to see where they ended up. According to ATF agents this goes all the way to the Justice Department. This never should have happened.

No operation of this magnitude could have been allowed to go forward without being approved by Holder and Obama. Then they have the nerve to stiff Congressman Izza and his committee with redacted, unreadable documents. I think that the fact that agent Kerry was a Marine Veteran, we should flood various Marine Corps sites about this travesty in an attempt to raise consciousness about this issue and demand answers about operation “fast and furious”. God Knows the Corps has lost 100’s of thousands of Marines who willingly gave their lives for their country. This Marine lost his life to harebrained schemes hatched in Washington who think bean bag guns provide protection against a State that had 40,000 murders last year. I assure you not one of the forty thousand was caused by a bean bag,.I think that every Marine should send a letter to their Congressman. I am no electronic wizaed but if you use Google and look up Atty Paul Marchand..Attorney Arizona, he has a good protocol for writing to a Congressman. As the Commandant said one month ago “the term Former Marine has been abolished” Once a Marine always a Marine. How long does it take to write a letter for one of our own, Congressman Izza is running the investigative committee.

You are 100% right, there is no way this operation was not ordered from the highest levels of government. It is time we get to the bottom of this and Issa has been doing a great job in spite of the obstructionism of Eric Holder and the DOJ. People need to contact their reps and keep the pressure on until justice is served!

Thank you so much for your service.
