Gunrunner: “Justice” Department violated federal law while implementing Fast and Furious

  As if it wasn’t bad enough that Eric Holder has committed perjury, obstructed justice, and tampered with evidence at the murder scene of Brian Terry it is now being brought to light that the “Justice” Department was possibly in violation of two federal laws which were specifically written to ensure the federal government did not transact with drug cartels when the deadly operation known as Fast and Furious was implemented:

 A few years ago, the International Emergency Economic Powers Act (50 U.S.C. 1701, the follow-on to the Trading with the Enemy Act) was expanded in order to criminalize anytransactions between U.S. entities — to include departments and agencies of the U.S. government — and all foreign drug cartels.

I am familiar with these prohibitive statues because several years ago, while serving as the senior drug analyst for the Senate Intelligence Committee, I was tasked to initiate and became the principal drafter of legislation which became known as the Kingpin Act (21 U.S.C. §§ 1901-08). The Kingpin Act is an extension of the highly successful IEEPA sanctioning program specifically targeting Colombian drug cartels. It expands sanctions authority against various drug cartel operations worldwide — including Mexico — which have been determined by the president to be threats to the national security, foreign policy, or economy of the United States. 

  And even if Eric Holder was ignorant of the law ignorance of the law is no excuse from it:

It is not necessary that an individual or governmental entity be shown to have “knowingly” violated any of these programs: it is illegal for any U.S. entity or individual to aid, abet, or materially assist — or in the case of Operation Fast and Furious, to facilitate others to aid, abet, or materially assist — designated drug traffickers. There are no exceptions within IEEPA programs for unlicensed U.S. law enforcement or intelligence agency operations.

  But yet that is precisely what happened under the Eric Holder/Barack Obama “Justice” Department–the Obama regime aided and abetted Mexican drug cartels in violation of federal law in order to “prove” the 90% lie and create a “crisis” in order to implement an assault weapons ban on law abiding American citizens. 

  The law does provide for an exception however:

There is a provision in the Kingpin Act for “authorized” law enforcement and intelligence activities, however the only procedure by which an Operation Fast and Furious program could have been “authorized” under the Kingpin Act was by the U.S. attorney general requesting a waiver (known within the Treasury Department as a Specific License), prior to any such operation being undertaken

  Of course we know that Eric Holder has denied all knowledge of the operation so it seems highly unlikely that he requested this waiver, that is, unless he is lying about what he knew and when he knew it–in that case he perjured himself.

  Either way, the results are the same: Either Eric Holder knew about Fast and Furious and violated federal law in order to implement it, or he was ignorant that members of his “Justice Department were engaged in illegal activity. It really doesn’t matter which one is true because as I stated above; ignorance of the law is no excuse from it.

  Eric Holder needs to resign and await prosecution because his violation of federal law–whether knowingly or unknowingly, and the highest prosecutor in the land should at least know the laws–cost Brian Terry his life while he was defending the borders of the United States against people the government armed.

    I would give my typical ” drip, drip, drip,” response, but this administration is so corrupt, that it doesn’t matter how much evidence comes out, he won’t resign.

      I am afraid you are right Matt, this administration believes the end justifies the means and they believe that Brian Terry’s death was collateral damage and acceptable. They honestly do not believe they did anything wrong.

    I agree with Matt. Unless this really starts to hurt Obama, he will not resign. This is why I say there is enough evidence to indict Holder, so what are they waiting for? Maybe they want to time it to happen closer to the election. I’m at a loss.

      Issa said the special prosecuter would probably be named after the first of the year. He has so much evidence against Holder that he doesn’t want him to escape on a technicality so he is making sure he was everything in order first.

    If I remember correctly these were enacted because of the Democrats outrage to the Iran/Contra issue. It was used as a way of denouncing Reagan?

    Funny how it’s bad for one administration to commit an act that outrages one group but for that outraged group it’s just part of the “Game”!

    The real question is whether anyone has the courage to bring charges against him and how he and Obama would react if they did! He is not going to resign, and Obama has no interest in him doing so. They have proven over and over that they feel the law does not apply to them. Unfortunately, no one has bother to instruct them otherwise!

      Holder did say we were a nation of cowards, le’t show him he was wrong by sending him to jail where he belongs!

    I think Obama needs Eric for the upcoming election.That way the goons will feel safer. Another reasone he has to hold on to him is he knows if he gets rid of him, a new candidate will come forth and all of this will be hard for the MSM to disregard.

        After watching the news today about the bomb scare in Germany, am I wrong to wonder IF it is coming as a bit of side show for tomorrows AG Holder questioning? We have to have ALL the New York banks on high alert, as well? I have to think it has something to do with it as something else for the MSM to focus on instead of the Issa/Grassley committee. Already it is all over the news, along with Blago and his 14 years in the slammer. Surely we can not be bothered with something so small as F&F or the “money-wash” they possibly did!
