Rep. Steve King plans to sue Barack Obama for implementing the DREAM Act through Executive Order

  When we learned earlier today that Barack Obama had decided to once again bypass the Congress and rule the nation by dictate by passing the DREAM Act through Executive Order one of the things I was watching for was the reaction of those in the Congress. To my disappointment, with the exception of Allen West and Lindsey Graham, the members of the Congress remained surprisingly silent but that might be about to change.

  Rep. Steve King has announced that he plans to sue the Obama regime to halt the implementation of this new law.

I will tell you that — I’m not without experience on this — I’m prepared to  bring a suit and seek a court order to stop implementation of this policy,” King  said

“I have done it once in the past successfully when then-Governor Tom Vilsack  thought he could legislate by executive order — and the case of King vs. Vilsack  is in the books. And that individual, by the way, is now the Secretary of  Agriculture. I wonder if he’s not counseling the president on his legal  proceedings.”

Huckabee followed up, asking King: “You plan to sue this administration for  implementing something that you believe should have required legislative process  and approval?”

“That is correct,” King replied

   As you can read in the above quote Steve King is not without experience on this issue as he has successfully sued the governor of his state when he tried to overstep his authority and rule by dictate, so it does seem as if a precedent has been set. There is no doubt in my mind that Barack Obama is breaking new ground with his use of the Executive Order because he is not issuing orders on how to execute various laws and functions of the government, but rather he is actually writing new law and it is unacceptable for him to bypass the Congress. He is abusing the power he has been entrusted with by the American people and he must be held accountable.

  Hopefully more members of the Congress will join Steve King and demand that Barack Obama halt what I believe to be an unconstitutional power grab.

    The prospect of impeachment proceedings and an Attorney General held in contempt of congress is very very appealing leading into the election. Now if only the dems in congress hold firm in their support for these thugs Romney should skate and the Senate is in play big time.

      This would be a very bad scenario for Barack Obama and for some reason he has made the politica; calculation that this will help him more with the Latino vote than it will hurt him with the rest of the vote. But if he faces a court challenge during the election I think it can only hurt him.

    Is pushing thru this EO a desperate move of someone that knows he is running out of time? I know he wants more votes, so he might be trying to buy them by doing this, but I wonder about what I said first, as well. Rep. King has a good track record of going after people and things he thinks are crooked. Maybe a few others should follow in his footsteps. Let’s sit back and see how this gets played out, shall we?

      I think it is a sign od desperation. As he loses support he is getting more desperate and he is doing things like this and “evolving” on gay marriage purely for politcal reasons and is playing to certain groups. People saw through the gay marriage thing and that stance didn’t really change anything but this does and he needs to be stopped. ANy congressman who dusn’t support King must be voted out of office.

    If King cna get the court to stay Obama’s action, this will be fun ti watch as it plays out. The 800,000 will still vote for Obama,however.

      Jim, I hope you are not buying that number of 800,00 ( I know you are NOT). I know that is what they tell us, but I think it is just a tad over that, just saying! Ok, ALOT over that amount. We have earned the right to sit back and watch for awhile for something positive to come out of this administration, haven’t we?

      It will be fun to watch Jim, you’ve got that right. You make a good point, the mere fact that he did this could be enough to win over the voters he was trying to win over, he can turn this around on the evil Republicans if it is stopped.

    I am glad he is suing. What Obama did today was simply unpatriotic. You don’t bypass Congress for something like this and you don’t do it so close before an election.

    I don’t want to say this should be impeachable but I hope it comes back to bite him in the ass in November.

      I have been one that hasn’t thrown the word impeachment around, but I am getting to the point where I think it might be time to at least have someone in the House start talking about it. Of course the easiest way to get him out of office is to vote him out and that is what we have to be focused on.

    When you have a President who attempts to usurp the constitutional authority of congress and take action beyond the executive branch’s constitutional authority are they in violation of their oath? Article I, section 1 states: All legislative Powers herein granted shall be vested in a Congress of the United States, which shall consist of a Senate and House of Representatives. The President clearly believes he and his position is above the constitution and if this is case he is failing to preserve, protect and defend the Constitution of the United States per his oath. And if this is the case could this be viewed as an impeachable offense? After all the constitution is the law of the land, the law that he is charged with preserving, protecting, and defending. If he knowingly commits these unconstitutional acts couldn’t it be viewed as an impeachable offense? I’m kind of talking through this because I’m not sure Steve. Any inputs from the good people would be appreciated.

      The president is willfully confusing legislating the laws and executing the laws. He has written new law and that is clearly not within his authority. I haven’t thrown around the word impeachment but it seems to me we might be getting close to looking at it if he continues to do this heading into the election. One thing is certain, this law needs to be halted by the courts.

    I hope he follows through with this and sues the pants off the Obama administration. If this isn’t unconstitutional, then we might was well throw out the Constitution.

    Probably a legitimate lawsuit – apparently, there are many people who need clarification on what exactly executive orders do and do not do, and when they are and are not appropriate.

    A similar situation occurred about half a century ago, when the President eliminated segregation in the US military, a move many felt should have been subjected to the legislative process, and determined by the people’s representatives.

    However, if we can agree (and perhaps we cannot) that the overwhelming majority of illegal aliens are economic refugees (and thus ineligible for asylum), the greatest victims are those who were brought here as children. Someone who barely meets the qualifications for this program – i.e., 16 years old, in the country 5 years, and never arrested for a felony – would be far more a stranger in his or her own country upon being deported than they are here.

    Again, I can only shake my head in wonderment at the self-proclaimed Christianity of all those who are so opposed to even this mild measure. Can you honestly say that Jesus would advocate hunting these children down and deporting them to lands where the economic environment is even more difficult than it is here? To lands where many of them don’t even speak the language, considering that they’ve been educated exclusively in English?

    Yes, it should have happened far earlier in his Presidency, and coming as it does today it’s obviously an election-year ploy to mobilize the growing Latino vote (and how do the T-Party folks feel about the fact that between them, Latinos and blacks will soon be in the majority, wonder?)

    Has anyone else thought of what is going to happen if Obama gets voted out?. There is that time from the election to the new president taking office in which all hell will break lose. Either it will happen then or we will have another 4 years of hell

      I have thought about that as well because we saw what he did with a lame duck Congress in 2010 and this will be many times worse. But four more years of Obama is a very scary thought, at least we might be able to undo some of what Obama does if he is a lame duck in November.

    Anyone who thinks this is anything but an election stunt needs to come see me about a bridge, because it is clear you will buy anything.
    However, Obama KNOWS this is a 3rd rail; touch it and you can die. Read “thegeorgiayankee”. I don’t agree with his position, but how in the world can the rule of law win when the opposition lables us as “hunting these children down”? My God, with such vitrol, Obama knows he not only buys votes, (as TGY says, we better look out) but makes ANY opposition look bad. Nobody cares what the law says anymore, just do what makes you feel good.
    Obama paved the way with Gay Marrage, and he knows this is just what his disappointed, demoralized base wants to see.

    I’m neither Democrat nor Republican but somewhere in the middle. That being said, I find it horrifying that someone like Rep. (use that term loosely) Steve King was elected by the American people. He is crass, vile and makes a mockery out of public office. He is all about greed and all that comes with it. Class A definition of a narcissist. To put it into simple terms…yuck.
