Gunrunner: A Federal judge rules against Eric Holder on his attempt to keep the Fast and Furious documents sealed

  Since June 20th of 2012, the day Barack Obama sealed the Fast and Furious records using Executive Privilege after Eric Holder begged him to do so, there has been very little to report on the Fast and Furious scandal. This, of course, is why Barack Obama sealed the records in the first place, but that might be about to change with this news today.

  After Barack Obama sealed the records Darrell Issa and his Oversight Committee filed a lawsuit to get those documents released. Eric Holder and the Department of Injustice naturally moved to have the lawsuit dismissed and today that request was denied by a Federal judge:

In a ruling Monday night, U.S. District Court Judge Amy Berman Jackson turned down the Justice Department’s request to dismiss a lawsuit brought by the House Oversight and Government Reform Committee after President Barack Obama asserted executive privilege to prevent some records about the administration’s response to the “Operation Fast and Furious” gunrunning scandal from being turned over to Congress.

“This case presents the sort of question that the courts are traditionally called upon to resolve,” Jackson said in her 44-page decision, issued more than five months after lawyers argued the issue in her packed courtroom and more than a year after the House committee filed suit. “Dismissing the case without hearing it would in effect place the court’s finger on the scale, designating the executive as the victor based solely on his untested assertion that the privilege applies,” she wrote.

  This is great news for Darrell Issa, the Oversight Committee, and all those who simply want to learn the truth about who knew what, and when they knew it in regards to this deadly scandal, but this is only the beginning.

  While the lawsuit can now move forward there is no guarantee a Federal court will demand the Obama regime release these records, however this could have been squashed without a fight and at least now the fight can continue. This is going to be a long battle, and in the end it is quite possible we will never learn the truth, but at least for now there is still a chance we can someday learn the truth.

    Small victories a very welcome, my friend. But, as you said, it is still a long up hill battle, which will get very little play in the media.

      It will get no play in the MSM, but at this point we have to take whatever victories we can get.

    I had read obama was trying to pack this court since a lot of these types of cases come through it. So far the GOP has been blocking the nominees if I recall correctly. Let’s just hope this gets through first.

      I don’t doubt that for a second! This will be slow walked through the courts while Obama tried to get his judges appointed; here is to hoping this moves fast enough to prevent Obama from stopping it.

    It bothers me that important cases fall to the way side of public opinion so quickly. We the people need to start holding our representatives accountable. We are swept off so quickly by the next big thing. Wherever the media takes us – The next shooting, the next government shutdown, the next celebrity scandal, etc. The public can be so easily distracted.

      Exactly, this never got the attention it should have and the MSM found excuse after excuse for not covering it. This is the case with everything else Obama does as well, from Benghazi to the IRS and NSA scandals, the media always has something else to use to divert us from the real stories.

    Well, there’s nothing to stop them from blotting out entire pages and submitting them if they’re forced to. They’ve done that in the past. This is a glimmer of hope though.
