The Obamacare website’s lack of security violates Federal law

 Considering the fact that Barack Obama picks and chooses which Federal laws he will enforce and which ones he will ignore, this news should come as no surprise.

  It has been well established, at least in the blogoshere, that the Obamacare website had no security built in and is considered to be a hacker’s paradise, but now we are learning that the healthcare website might actually be in violation of Federal security laws:

The bureaucracy tasked with Obamacare implementation may be violating a law that requires government agencies to keep private information safe.

Under the the Federal Information Security Management Act (FISMA), the Department of Health and Human Services’ Center for Medicare and Medicaid Services (CMS) is required to have an “Authority to Operate,” or ATO. In order to receive an ATO, new information tech systems must perform a set of tests, including “Security Control Assessments” (SCA).

But according to CMS’s 2014 budget request, no such security assessment took place. The Federal Healthcare Marketplace website was rolled out without full end­-to­-end testing.

Indeed, the large number of new systems created because of Obamacare created a backlog of testing. CMS could not complete its required security. Failing to complete the required means no ATO, and hence a violation of federal law under FISMA.

FISMA was enacted in 2002. Under FISMA, federal agencies are required: “to develop, document, and implement an agency­-wide program to provide information security for the information and information systems that support the operations and assets of the agency, including those provided or managed by another agency, contractor, or other source.”

Centers for Medicaid and Medicare Services is responsible for the oversight and implementation of the Federal Healthcare Marketplace website and associated systems.

  Of course Barack Obama has never been one to let the laws get in the way of his radical agenda, so why would this be any different? The end justifies the means…..

    I think all these OC issues are false flags. We are so focused on the minutiae that we have taken our eyes off the nationalization of our health system. The Rep are too busy rearanging the chairs on the deck of the US Titanic to be of any use.

      But all these little issues add up to the larger picture and that is the nationalization of the healthcare system. That was the plan all along and it is working exactly as planned. The Republicans don’t want to do anything about this right now because they want to use Obamacare as an election issue.

    You are right with Obama the law doesn’t matter and few seem ready to challenge him when he skirts or breaks it.     Trust me, with my background in healthcare, another year will be far too long for the GOP to get its act together. The destruction will be far too great if the employer mandate comes into being. Obama is simply laying waste and will rule by decree regardless of the 2014 election. No medical groups or private practices will exist. They will have to merge onto mega hospital systems. In the end, just employes who will have a salary dictated by the reimbursement fee. A hearing is going on right now with the Docs.

    Just as the OC and Insurers cabal was sealed with promised bailouts once the number of insureds don’t generate the dollars needed so will the AMA be bought off. Only a wholesale rebellion can put asunder what Obalama and his comrades have joined together.
