A Federal judge has ordered the NSA to stop destroying evidence…..for the third time

 NSAThe NSA is facing multiple lawsuits in regards to its spying program. Under the law the NSA must destroy metadata which is over five years old, however the agency has been ordered to stop destroying the records because they could be used in the upcoming lawsuits. In other words; these records are now evidence.

  However the NSA has been ignoring the order, and the agency went so far as to apparently mislead the FISA court to muddy the water, so now another Federal judge has ordered the NSA to stop destroying evidence…..for the third time.

  Here is more:

A federal judge has ordered the government to stop destroying National Security Agency surveillance records that could be used to challenge the legality of its spying programs in court.

U.S. District Court Judge Jeffrey White’s ruling came at the request of the Electronic Frontier Foundation, which is in the midst of a case challenging NSA’s ability to surveil foreign citizen’s U.S.-based email and social media accounts.

According to the EFF, the signals intelligence agency and the Department of Justice were knowingly destroying key evidence in the case by purposefully misinterpreting earlier preservation orders by multiple courts, multiple times.

  What was the NSA’s response? Whoops, it was a misunderstanding, we didn’t know you were talking about email correspondence was well. The NSA then turned around and asked the judge for a stay on his order so the agency could continue to destroy its evidence because a delay would “cause severe operational consequences.”

  The NSA just needs a little more time, can’t this judge see that? The NSA will stop destroying evidence just as soon as it can…..when there is none left!

    And if they don’t conform to the judge’s order Eric Holder’s DOJ will kick some NSA ass …right after Obama ‘s shirtless selfie goes viral.

    How many of us ‘really believe’ that this evidence is destroyed – meaning back-up somewhere or left right where it is – how would anyone know unless they have access? And the access could be limited to only a lower security site that is miss the info – just like what happens on the main internet when ‘condemning truth is mysteriously lost’.
    Interesting how an entity (NSA) can profess itself to be ‘for the safety and protection of everyone at large’ but lose only the evidence Justice needs to work!
    They probably have ‘Grandma’s Secret Receipt’ hidden away somewhere and haven’t lost that, why lose this stuff! Reminds me of Clinton’s and Foster. The “Whoops” generation of doing biz.

      That is a great point that I hadn’t considered! Is this info really being destroyed or is it simply being moved?
