The IRS admits amnestied illegal immigrants are eligible for a tax rebate even if they didn’t file tax returns

  IRS Commissioner John Koskinen had previously told the Congress that illegal immigrants who benefited from Barack Obama’s Executive Action on immigration could receive tax rebates for years they worked in the United States illegally but only if they had filed tax returns for those years. 

  However he has now amended that statement and has admitted that amnestied illegal immigrants are now eligible for tax rebates even for years in which they never filed a tax return. Here is more:

IRS Commissioner John Koskinen has confirmed to Congress that illegal immigrants granted amnesty under President Obama’s new programs could claim back-refunds even when they never filed returns to pay their taxes in the first place.

“To clarify my earlier comments on EITC, not only can an individual amend a prior year return to claim EITC, but an individual who did not file a prior year return may file a return and claim EITC (subject to refund limitations under section 6511 of the Internal Revenue Code),” Mr. Koskinen said.

The lawyers said since the EITC is a refundable credit, that’s allowed even when the illegal immigrants worked off-the-books and never paid taxes in the first place.

“Section 32 of the Internal Revenue Code requires an SSN on the return, but a taxpayer claiming the EITC is not required to have an SSN before the close of the year for which the EITC is claimed,” Mr. Koskinen said. “At your request, the IRS has reviewed the relevant statutes and legislative history, and we believe that the 2000 Chief Counsel Advice (CCA) on this issue is correct.”

  The definition of rebate is: a partial refund to someone who has paid too much money for tax, rent, or a utility. Using this definition it is unclear to me how a person could have paid too much money when in fact they paid no money in the first place. This is not a rebate but rather a government handout.

  This leaves me wondering if American citizens who also failed to file a tax return for years in which they should have will also get the same break or will they be treated differently? I think we know the answer…

    The Democrats suck.
    and I am not sure about the Republicans.

        Steve, I do not think we are even ON their list anymore. The only thing we are good for is our tax money to fund their illegal programs for illegal aliens….there, I said it!

        One more thing….our Government is a JOKE and it seems that none of us are laughing anymore (even some that voted to put this Administration into office).
