GOP memo claims the FBI withheld information from the FISA court when it sought surveillance

  deep stateI have to admit I was a little disappointed with the GOP memo which was released today because for the most part it just reaffirmed what some of us have been writing for quite awhile now.

  We already knew the Russian dossier was used by the FBI in order to obtain a FISA warrant but I think the one big story to come from this memo is that the FBI withheld information from the FISA court when it sought surveillance of Trump Tower.

  When the FBI went to the FISA court with the Russian dossier the department failed to inform the secret court that the dossier was unconfirmed and it also failed to disclose that it was paid for by Hillary Clinton and the Democratic National Committee even though they knew this was the case at the time.

The memo prepared by staff of House Intelligence Committee Chairman Devin Nunes (R-Calif.) was released today, alleging as expected that the FBI withheld information from the FISA court and going hard after the British intelligence operative who crafted a controversial dossier.

Renewal by the FISA court, the memo states, “is necessarily dependent on the government’s production to the court of all material and relevant facts,” and “should include information potentially favorable to the target of the FISA application.”

“In the case of Carter Page, the government had at least four independent opportunities before the FISC to accurately provide an accounting of the relevant facts,” the memo alleges. “However, our findings indicate that, as described below, material and relevant information was omitted.”

The memo states that the Democratic National Committee “paid over $160,000” to former MI6 operative Christopher Steele, referred to as “a longtime FBI source,” via law firm Perkins Coie and research firm GPS “to obtain derogatory information on Donald Trump’s ties to Russia.”

The October 2016 FISA application to the court, as well “any of the renewals,” the memo continues, didn’t “disclose or reference the role of the DNC” or “any party/campaign in funding Steele’s efforts, even though the political origins of the Steele dossier were then known to senior DOJ and FBI officials.” 

  It has also been reported in the past that other requests by the FBI for surveillance were turned down by the FISA court it one would think that if the FBI disclosed this information this attempt would have been denied as well.

  I have heard the term “fruit of the poisonous tree” bandied about the last couple of days. I had not heard the term before but basically if evidence is gathered illegally it is not admissible in court.

  Does this fall into this category?  I am not sure but the FBI was required to disclose all relevant information to the FISA court and the department failed to do so, which would mean the FBI got the FISA warrant fraudulently. Or illegally…

  If the GOP memo is true and it can be proved I would expect somebody to make this challenge in court. I do not expect anyone to go to jail over this except maybe lower level employees who are forced to fall on the sword to protect the deep state but perhaps this could be the beginning of the end of this witch hunt or, if you prefer, this fishing expedition. Perhaps this is why Robert Mueller is delaying Michael Flynn’s sentencing.

    Who is the judge that signed this piece of crap?

    This may or may not apply.

The penalties for either act are fines up to US$10,000, up to five years in jail, or both. USC 50 36

    Repeal all these unconstitutional laws! Get the FBI out of foreign intelligence. They have screwed up one case after another and have caused terror instead of preventing it.

      Good points. I heard that the Nazi CIA too over the FBI years ago. None of them in leadership position are who they purport themselves to be. They ‘construct, cause and implement’ dangerous and killing viruses and situations to further their ‘neck hold’ (under their thumb) control and power over the pawn masses.
      Their seeing themselves as ‘of more worth’ needs to be corrected.
      The body of a Nation must rid out the unhealthy elements to live and prosper.

        Yes, they do feel as if they are “worth” more than the people they believe they rule. They forget they do not “rule” they “represent.” They work for us but they feel as if we work for them.

    An interesting thing, I remember the days when newspapers in the city would have a corruption article of a cop, usually something like taking money from a speeder and not issuing a ticket. Every cop in the city, lost every case in court, no matter what the charges were. Juries simply went against police, all police, because of some jerk. One bad cop, means that every other cop walks around with a bloodied nose attributed to the one bad cop.
    Personally, if I ever get onto a federal jury, and the FBI is involved in the case, I will render my verdict against the FBI. I no longer trust the FBI.

      Yep, bad, rotten infested apples spoil the whole barrel. It’s as though the barrel (the world) has been flipped ‘top side down’ so the slug has been ruling.
      Those ‘few bad apples’ have taken over positions of control and leadership and they need to be expunged!

        Great verses! The world has been turned upside down and we know who the master of this world is. Our “leaders” think they are the rulers but they are serving a master.

    Once again the GOP gave the Dems plenty of time to set the table with their spin and put the GOP in the defensive position. I also blame the press of course. No one other than us junkies are following this, so it was a let down. Keep your eye on the Flynn matter. It may have a lot more legs than is being given credit. The judge was forced to recuse himself, looks like the FBI may have lied in their 302’s, sentencing postponed. Not to self promote, but I have an interesting post today – Is the FISA court dirty… I think so, and it may be the most dangerous thing ever to our Republic.

      Isn’t Flynn’s judge now Judge Suillivan? His former judge was Judge Contreras whoalso sits on the FISA Court. Maybe he got cold feet or a guilty consciences?

    I like your assessment and those comments stated here, of the ‘same (sane) mind’!
    This Memo fiasco is like a Reality Show with all the actors playing their parts to ‘agitate’ ‘irritate’ and deflect “once again” from the matter of ‘stopping further corruption.’
    Many of them in leadership positions (including Hill, O, C, Chicago connection, etc.) need to be sentenced and “harshly” convicted. Some on Twitter are mentioning GITMO + Waterboarding. Can we envision that? are these ‘high minded dark spirit workers’ more worthy than the terrorist they hire not to have that [waterboarded] done “unto them?”
    I’ve not heard that term “poisonous tree” used, but recently was thinking that “the Tree of Knowledge” seems to producing more “bad” (poisonous) fruit to be eaten than GOOD! When the corrupt rule people suffer.
    Is that why Kerry is popping up from the slime pit? Turn UP the Fire of “Purification” and scoop off the lechery, filth, ribald (pervs & pedos) and Baal worshipers. May God Help us!

      Thank you. I don’t see anyone going to jail over this, they have too much support with the deep state. The best I think we can hope for is a speedy end to this investigation and probably a special counsel to investigate the special counsel.

        haha, I know, nuts isn’t it. Drags on and on. Oh ‘GREAT THINGS” are happening … for who? Where? Where’s the hammer of Justice coming down on our domestic enemies, the very one’s that would benefit the world by taking them off the stage, binding them up and silencing their mouths.
        It may be Steve that man just isn’t capable of doing what needs to be done. The old adage: There won’t be true Peace until the PRINCE OF PEACE returns, and even then He’s comes in Wrath, Vengeance, slaughtering all who needs to be removed. Now THAT’s taking care of things!
