Alaska sues the Obama regime over new costly shipping regulations illegally implemented by the EPA
Beginning on August 1st the EPA has ordered Alaska to start using a low sulfur fuel in all her large marine vessels. Meeting this new regulation would be costly and naturally that means the price of all goods transported by ship from Alaska would necessarily skyrocket.
The Alaska Department of Law said in a statement that the low-sulfur-fuel requirement would be costly, jacking up prices for products shipped by marine vessel and harming Alaska’s cruise industry.
“Alaska relies heavily on maritime traffic, both for goods shipped to and from the state, and for the cruise ship passengers who support thousands of Alaskan jobs
The EPA is using an amendment to the MARPOL treaty as justification for this new order, but there is just one little problem with this. The amendment was signed onto by Hillary Clinton in 2010 but it still has not been ratified by the Congress so this is still not the law of the land and cannot be enforced.
Alaska is suing the EPA and the Department of Homeland Security to block the EPA from implementing this regulation pending the outcome of a vote in the Congress. It has been two years since Hillary Clinton agreed to the amendment and it still hasn’t been voted on; this tells me there is not enough support to gain the two-thirds majority needed to pass the amendment and the Obama regime simply felt as if they could slip this through without notice to avoid a confrontation with the Congress over an upopular amendment to an existing treaty.
It wouldn’t be the first time the Obama regime has snuck around both the constitution and the Congress to implement his policies, and it isn’t even the first time he has used the EPA to accomplish goals which he couldn’t get through the Congress, and it seems as if he is getting bolder with every action he takes because of the unwillingness of the Congress to take him to task on these issues.

Other than a handful of people, Congress does as they are told, but not by US, who have put them there. Does this make any sense?

It has gotten out of hand when we pay their salaries and they tell us how things are going to be. Since when were they put there to make their own decisions? Aren’t we the ones that should be telling them what we want?

What’s with all this weak-kneed, spineless suing of the overreaching feds by the States?!?!?! What a waste of time and money! To what sensible end? For God’s sake, when the feds ignore the constitutional contract between the States and feds, per the 9th and 10th Amendments the States are duty-bound to simply and summarily IGNORE the federal rulings/edicts/laws/regulations. What the hell is so hard about that concept? It’s nice to say we’re a nation of laws, but when only one party to the Contract remains faithful to that Contract, then the Contract is, for all practical purposes, null and void. Let the Constitution be our guide! Watching all these suits going forward from the States is mind-bogglingly laughable and useless. It also strikes me as terribly negligent and cowardly. Get some spine and principle, States! Stop whining and do the right thing!!! Geez!!!

I wouldn’t even worry about a lawsuit, if I were the Governor of Alaska. I would just state, as plainly as I could, that the EPA ruling had no affect because it was not the law. As such, the EPA has no enforcement possibilities.

It’s the well-founded principle of nullification championed by both Madison and Jefferson. But, by the way the States are behaving, one would think they’d never heard of either Madison or Jefferson, much less nullification.

Eh . . . let’s see what the courts have to say. I’ve learned that sometimes certain facts get omitted when these stories are reported, and people get heated up – which is often the probable reason the facts were omitted.
As to the EPA, let’s not forget that it’s actually prohibited from considering economic costs when issuing regulations pursuant to the Clean Air Act; perhaps they got it into their heads that that prohibition applies to all regulations.
Otherwise, if the facts are as reported in the linked article and again here, then it would appear the EPA overstepped its authority.

Yes, we will have to wait to see what the court says. I honestly felt Obamacare would be thrown out, I didn’t think there would be any way the court wouls rule the government could force us into an activity through taxation but I was wrong. I no longer will be surprised by any court ruling.
I didn’t mean to imply that the EPA was doing this in order to drive up costs, just mentioning it as a side effect of the law. However I wouldn’t be surprised if Obama knew what the costs would be because we have heard his administration in the past talk about getting people out of their cars, and brainwashing people about gun control, the EPA simply provides him with a means to reach his end.

B, loopholes or not, there has been alot just handed to us as “this is how it is going to be” like it or not. Legal or not, doesn’t matter, I guess. There are higher powers at work here than we have the ability to reach to vote out. I am sure it has been all planned out and there are the usual puppets that are putting it into play.

I am afraid you are right Lou, there are machinations at work here from people behind the scenes who are unelected and we have no control over what happens. Sometimes I feel as if there is nothing we can do but we must keep fighting as long as we can.
