Obamacare architect caught for a second time admitting the Federal exchanges cannot grant subsidies
When being interviewed by Chris Matthews one of the people credited as being an Obamacare architect, Jonathan Gruber, discussed the court decision which ruled that Federal exchanges could not grant subsidies and he, like most Democrats, claimed that this was simply a typo and was not what was intended when the law was written.
Here is what he had to say:
Chris, it is unambiguous this is a typo. Literally every single person involved in the crafting of this law has said that it`s a typo, that they had no intention of excluding the federal states. And why would they?
Well we soon found out why the law excluded Federal exchanges when a 2012 video surfaced in which Mr. Gruber explained why they were excluded. It turns out that this was done on purpose to coerce the states into setting up exchanges–it was not a typo.
What’s important to remember politically about this is if you’re a state and you don’t set up an exchange, that means your citizens don’t get their tax credits. But your citizens still pay the taxes that support this bill. So you’re essentially saying to your citizens you’re going to pay all the taxes to help all the other states in the country.
I hope that that’s a blatant enough political reality that states will get their act together and realize there are billions of dollars at stake here in setting up these exchanges. But, you know, once again the politics can get ugly around this.
When questioned about this video Jonathan Gruber claimed it was a “speak-o” and apparently he did not mean to say what he said. However, according to this article he has been caught a second time saying what he did not say.
a second audio tape has now emerged of Gruber making the very same comments yet again.
“That is really the ultimate threat — will people understand that gee, if your governor doesn’t set up an exchange, you’re losing hundreds of millions of dollars in tax credits to be delivered to your citizens,” Gruber says in the audio clip,resurfaced by Morgan Richmond and John Sexton. “So that’s the other threat, is will states do what they need to do to set it up.”
So who are you going to believe; Jonathan Gruber circa 2014 or Jonathan Gruber circa 2012 before he was caught?

I just caught this on Fox. Pants on fire on this one. We always knew though, but there is nothing like the internet now is there?

I have to admit I bought into the typo excuse because I did not see any reason why they would purposely exclude the Federal exchanges but in light of all of this it is becoming obvious this was intentional. They would have been able to get away with these lies not all that long ago but now every speech and press conference is recorded by somebody so they cannot get away with it any more.

The only comparable thing I can think of is the Feds denying highway funds to states that didn’t change their speed limits, back in the 70s when there was a gas crisis. But that was aid to states – I wonder if it’s Constitutional to deny federal benefits to citizens simply because the state legislatures acted a certain way. I’v enever seen anything in the tax code that says you’re not entitled to this or that benefit if you live in a particular state.

I don’t know the answer to this but I am sure the equal protection clause may be used at some point if this decision is not overturned. I believe it most likely will be overturned but if they look at Gruber’s words and see the intent it might make it more difficult.
